Terms of Service

1. Acceptance of Terms
By accessing or using Breakdown (breakdown.works), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Breakdown is operated by Dalton Creative ("we," "us," or "our").
2. Description of Service
Breakdown is a creative methodology tool that analyzes creative works to extract structural principles, generates scored Methodology Cards, and enables concept generation through the Adaptation Studio. The Service uses AI models to perform analysis and generation.
3. Accounts & Access
Free Tier: You may use up to 3 scans without creating an account. Free scans include full CRS scoring and Methodology Card generation.
Founding Member ($49/mo): Paid subscribers receive unlimited scans, access to the Adaptation Studio, unlimited library storage, projects workspace, and shareable public cards. The founding rate of $49/month is locked permanently for early subscribers.
4. Payment & Billing
Payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly (or annual, if selected) basis. You may cancel at any time — access continues through the end of the current billing period.
Methodology Guarantee: If your first scan does not surface at least one structural insight you hadn't previously articulated, we will refund your first month's payment upon request within 30 days of subscribing.
5. Your Content
You retain ownership of all content you submit to Breakdown (URLs, files, text). By submitting content, you grant us a limited license to process it through AI models for the purpose of generating your Methodology Cards and adaptation concepts.
You represent that you have the right to submit any content you provide for analysis. Breakdown is a craft analysis tool — it does not reproduce, distribute, or create derivative works of copyrighted material. It analyzes structural and craft decisions.
6. Generated Content
Methodology Cards and Adaptation Studio outputs generated by the Service are yours to use. You own the creative concepts generated through the Adaptation Studio. We do not claim ownership of AI-generated outputs produced for your account.
7. Public Cards
You may choose to make Methodology Cards public via a shareable link. Public cards are viewable by anyone with the link. You can revoke public access at any time by toggling the card back to private.
8. Acceptable Use
You agree not to:
- —Use the Service for any illegal purpose
- —Attempt to reverse-engineer, decompile, or extract the CRS scoring algorithms
- —Use automated scripts to bulk-scan content or scrape the Service
- —Submit content that you do not have the right to analyze
- —Resell or redistribute Methodology Cards or Service outputs commercially without permission
9. AI Disclaimer
Breakdown uses AI models (including Anthropic Claude and Google Gemini) to analyze creative works and generate concepts. AI-generated analysis and scores are tools for creative development, not definitive assessments of creative quality. CRS scores are structural craft assessments — they do not predict commercial performance, audience reception, or artistic merit in any absolute sense.
10. Limitation of Liability
Breakdown is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your access to the Service at our discretion if you violate these terms. You may cancel your subscription at any time. Upon cancellation, you retain access through the end of your billing period and may export your Methodology Cards.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the State of Texas, United States. Any disputes shall be resolved in the courts of Dallas County, Texas.
